NEW YORK -- U.S. stocks finished down on Monday following their best two-day run this year, as investors waited to see if central bankers later this week will suggest more stimulus is in the offing.?
Investors have been hoping the Federal Reserve and the European Central Bank at this week's meetings will suggest further action to stimulate demand is on the way in the coming months. Last week a strong statement from ECB President Mario Draghi pushed the Dow above 13,000 for the first time since early May, and gave the S&P 500 its biggest two-day rally since December.
Early gains on Monday faded in midday trading, as did some of the optimism for meaningful stimulus.
According to preliminary calculations, the Dow Jones Industrial Average was down 3.71 points, or 0.03 percent, at 13,071.95. The Standard & Poor's 500 Index was 0.71 points lower, or 0.05 percent, at 1,385.26. The Nasdaq Composite Index was down 12.25 points, or 0.41 percent, at 2,945.84.
"I don't think American investors are sold on Europeans doing what they need to do to get the job done. People believe the Europeans have a harder time getting a consensus to solve whatever problems they have," said Peter Costa, president of Empire Executions Inc in New York.
The sectors least sensitive to consumer demand - telecom services, consumer staples, and utilities - remained up, but the healthcare, industrials and financial sectors declined.
"Right now we see things sitting on the sidelines. Regardless of what's happening in Europe, it's just as important what's happening in the U.S.," said Daniel Stecich, a trader with TJM Institutional Services in Chicago. "I think the Fed's going wait to see what the data brings before they make any type of decision."

WASHINGTON (AP) ? The federal government says baby bottles and sippy cups can no longer contain the controversial chemical bisphenol-A, or BPA.
The U.S. chemical industry's chief association, the American Chemistry Council, had asked the Food and Drug Administration to change its rule in October, after determining that all manufacturers of bottles and sippy cups had already abandoned BPA due to concerns about its health effects.
The chemical industry's request may help curb years of negative publicity from consumer groups and head off tougher laws that would ban BPA from other types of packaging because of health worries.
Legislation introduced by some members of Congress would ban BPA nationwide in all canned food, water bottles and food containers. Chemical makers maintain that the plastic-hardening chemical is safe for all food and drink uses.

Some points to consider when investing in gold stocks...
IT MAY seem as though almost any Gold Mining stock you see these days is a bargain just waiting to be plucked. While most stocks have seen major drops from their highs and some are showing significant price turns, others have more downside left and a few just won't make it to the next market peak.?
Ivan Lo, publisher of The Equedia Weekly Letter, takes both a macro view of market and economic conditions and then carefully studies the specifics of each stock he decides to follow or acquire. In this interview with The Gold Report, Ivan Lo talks about the critical factors that can separate a mega-winner from a rollback candidate.?
The Gold Report: Your newsletter, The Equedia Weekly Letter, talks mainly about Canadian companies you actively own. Why did you begin writing this newsletter and how do you choose the companies you invest in?
Ivan Lo: I've always been interested in the capital markets because they are the source of the world's growth. Without them there wouldn't be Google, Microsoft or Apple. My father was editor-in-chief of a prominent global newspaper, so I guess that's where I combined the two ideas. There are some extremely able men in our industry and I get to have some great discussions about investment philosophies, strategies and market outlook. We often trade ideas and go through what works and what doesn't.?
These brilliant men don't think like the average person; their thought processes are often beyond that of the average investor. That's how The Equedia Weekly Letter got started. I wanted to bridge that gap and turn complicated investment philosophies into something simple that everyone could understand, from macroeconomics to mining 101. My job is to make it simple and start with macroeconomics, the big picture. For example, I believe the precious metal sector is undervalued right now.?
First, I'll look at the project. Does it have value or is it just a crapshoot? When it comes to mining, drill results alone aren't enough. A company can drill spectacular numbers but if it is drilling in the middle of nowhere, those drill results are just shareholder Dollars turned into geological numbers for reference. The likelihood of that project doing anything anytime soon is very slim. But if it is drilling great numbers near an already producing mine, its chance of success becomes a lot higher.?
Then come the people behind it. If a project isn't managed by great people, I won't invest in it. I've been burned before by finding great projects only to have the management team destroy it because they didn't understand the capital markets. They raise a few million here and a few million there. They get excited. They spend it all and yet produce no shareholder value. Good drill results alone don't mean it's a success unless it brings shareholder value with the money that is spent.?
After that comes the capital structure. Who owns the paper and at what price? The last thing a lot of people don't consider is management's marketing ability. If a company is public, management needs to market it. The shares are only as good as what The Street says they are worth. At the end of the day, someone has to buy your shares from you at a higher price for you to profit. That's how the stock market works. If no one knows about the company, no one will buy it and your shares are worthless.?
TGR: Unfortunately, just because you get competent geologists running a company doesn't necessarily mean they know what they're doing when it comes to running a public company.
Ivan Lo: Yes. I've seen it time and again, especially in the past couple of years where we had a bull market for about a year and all these geologists went out and spent all their money yet created no shareholder value.?
TGR: There are so many bargains out there now that it seems almost anything you buy could produce a nice profit, assuming the company can obtain financing without diluting itself into oblivion. What do you look for now in a potential mega-winner?
Ivan Lo: That's true, but just because something is beat up doesn't mean it is a bargain. A lot of the stocks out there are still junk. As for a potential mega-winner, I go back to my investment philosophy. I look for a battered stock with a strong project and a management team capable of marketing its story to the world. I'm also looking for a company that is a potential takeover target.
It would have to be near a producing mine or be on the verge of some very significant milestones. Grades are important. People think that because you drill 100 meters and get 1 gram/ton that it's an amazing grade. It's not. High grade is the most important thing for projects nowadays, because the cost of exploration and production are rising like crazy.?
TGR: Lots of stocks are trading between a dime and a quarter. Some are going to survive and could become a ten or twentybagger. Other ones are probably going to be one-for-ten rollback candidates. How can investors figure out which are really alive and which ones are going to be dead?
Ivan Lo: It's funny you ask that question because I actually see a lot of these juniors being forced to roll back and many juniors going bankrupt or getting delisted. Investors need to know a company's actual cash position and burn rate. How much of its cash is allocated and already committed for spending??
Companies shouldn't just stop their drill programs because the market stinks. But, they need to be more conservative with their spending and know when and how to cut back. That's why they should focus on what will bring them results instead of drilling blind to see how far the mineralization extends. Management's primary goal is to maximize shareholder value and know when to cut back. If a company has a staff of geologists on the payroll that aren't doing much, I can bet you it will be a candidate for a rollback in this market.?
TGR: Unlike many years ago, when most work was done on a contract and project basis, a lot of these companies have built-in overhead that doesn't go away very easily.
Ivan Lo: That's why you need to know exactly how much of a company's cash is being allocated or if it has already been committed to these drill programs. Does the company have to go out and finance in this market??
TGR: So, it's important to not just get all excited about new drill results but to know how a company will finance the rest of its operations.?
Ivan Lo: Especially in this market.
TGR: So, can you give us a little wrap-up and summarize what our readers should be doing or not doing at this point to try to make money and avoid losing money in this market?
Ivan Lo: The big one for most people is trying not to lose money. If you want to play it safe you buy the big names and, of course, straight silver and Gold Bullion. But, if you're looking for the best bang for your buck, I would continue to look at the beat-up junior market and follow my investment philosophy. Focus on management, takeover candidates, capital structure and marketing ability. A lot of these juniors still have some downtrend. But, many will be trading a lot higher two years from now, or even sooner.?
An easy way to start filtering them is to look for the ones that have already bounced from their 52-week lows on good volume. Those are a good start because it shows they're in an uptrend. If you're going to invest in juniors, you have to have the stomach for it. No risk, no reward. None of us invest in juniors to make a few bucks here and there. We invest to change our lives. If you have the patience and the guts, the junior market is going to give you the best bang for your buck.?

Gloucester Director of Rugby Nigel Davies has successfully recruited another key member of his coaching set up with the appointment of Tony Windo as the club's new scrum coach.
Gloucester born and bred, Windo started his playing career with the Cherry and Whites before moving up the M5 in July 1999 to join the Worcester Warriors.
He played three times for England and was named in the Sky Sports Dream Team in 2005-6 before finally hanging up his boots in 2008 having made over 400 appearances for Gloucester and Worcester combined.
He then moved into a coaching role at Sixways, firstly taking responsibility for the scrum and then the forwards before becoming Director of Rugby at Bromsgrove School in August 2011.
However, Davies has now persuaded the 43 year old to join the new look Gloucester Rugby coaching staff on a part time basis as Windo explained to the club website:
"I'm going to be working on a consultancy basis, coming in for one or two mornings a week, while continuing my role at Bromsgrove School.
"I consider it a great honour to get the opportunity to coach my home town team and one that I was proud to represent as a player. I'm delighted to be involved."
He will continue his role at Bromsgrove School and expressed his gratitude to the school for being so flexible and allowing him to pursue the Gloucester option.
"Nigel first spoke to me a couple of weeks ago and I had to talk to the school to make sure that any involvement with Gloucester was ok with them and that we could it make it work.
"I'm incredibly grateful to the school for allowing me to take up the opportunity, they've been very supportive and it couldn't have worked out better.
"Hopefully with my roles at Bromsgrove School and Gloucester, we are able to develop this relationship as an alternative pathway for future players into the Gloucester senior squad to assist the long term development of both the School and club.
"Gloucester's probably the only club that I would have considered getting involved with to be honest. I made a career choice to step away from full time professional coaching and work in an independent school and only the lure of a club like Gloucester would have tempted me to get involved in the professional game again.
Davies was only appointed Director of Rugby just over a month ago and Windo was quick to praise the former Scarlets man for the progress he's made at Gloucester in that time.
"Nigel's got a very clear vision of where he wants to take Gloucester and is very good at communicating that vision to others. He's made real strides in a very short space of time at Gloucester and I'm excited about the prospect of working with him.
"I've been in to do some work with the boys over the past couple of days which I've very much enjoyed and I'm looking forward to going out to France with them and taking that work on a bit further.
"It's funny how things work out. I started my career with Gloucester and my playing career finished at Gloucester when I played at Kingsholm in the Amlin Challenge Cup Final for Worcester.
"To be back there as part of the coaching team is a great honour and I'm really looking forward to being at Kingsholm on the opening day of the season."
Before finally accepting the role, there was one other thing for Windo to take into account and that was the fact that he would be taking over the scrummaging role from his late friend, John Brain.
"It was a very tough decision to make and, I'll be honest, I went to see Clare, John's widow, to talk it over.
"As I say, it's a great honour and something I desperately wanted to do but the circumstances were obviously very unfortunate.
"I had spoken to John previously about doing something along these lines but, I went over it with Clare, and she said that, if anyone were to do it, the family were happy that it was someone like myself, one of his close friends with a similar passion for the club.
"The challenge for me now, of course, is to carry on the great work that John started last year and do him and the club justice."

A report by Donald Gilliland of The Patriot-News on Sunday unveiled that while prominent Penn State administrators knew of an investigation of Jerry Sandusky in 1998 according to the Freeh report, Penn State president Graham Spanier was very involved in the prosecution of sports agent Jeff Nalley during the same year.
Nalley was convicted for taking former Penn State running back Curtis Enis on a $1,000 shopping spree to Harrisburg malls, as there is a law in Pennsylvania against such behavior from sports agents.
A great deal of irony comes from Spanier's comments regarding Nalley's behavior, and the damaged it could have caused to the university's name.
The man "fooled around with the integrity of the university," Spanier said, "and I won't stand for that."
What Nalley did was certainly wrong, the problem with the comment is that Spanier was doing the same exact thing for his handling of Sandusky's crimes, which were far more grave than taking a player on a shopping spree.
Nalley was sentenced to 100 hours of community service after being convicted, and was named "persona non grata," banning him from the Penn State campus, while the Freeh Report found that there was no discussion of doing the same to Sandusky in 1998.

There's an old maxim in politics: When the going gets rough, it's time to get tough on immigrant convenience store clerks. Especially those who speak limited English and sell rolling papers and individually wrapped cigars to pot smokers in a poor part of the city.
That was today's agenda for Mayor Vince Gray, whose political career could be?teetering on the edge as the federal investigation into his 2010 mayoral campaign enters its end game: Gray decided to dole out a little justice of his own, regulatory style.
Hizzoner and a small army of city officials and community activists surprised convenience, liquor, and Chinese carry-out stores along Martin Luther King Avenue SE with impromptu inspections of their wares and business licenses. In a scene that repeated itself about a dozen times, Gray and the officials, including Department of Consumer and Regulatory Affairs Director Nicholas Majett, would walk into a store, head straight behind the counter (often without asking permission), and give the East African or Chinese cashier on duty a stern talking to about the products they were were selling that a marijuana user might find useful.
"You can't do that," Gray told the employees of the China Inn Deli, after he spotted an open box of cigars next to the cash register. "You opened that up and sell them as singles." (Gray brought along Julie Koo, his director of the Office on Asian and Pacific Islander Affairs, to help translate.)
The store's owner, who did not appear to speak much English, didn't disagree. "Okay, okay," he said, putting the cigars in a plastic bag and shoving the bag under the counter. He then tried to get Gray to take a free soda.
City law prohibits selling rolling papers (except in limited circumstances) and individually wrapped cigars. Most of the stores Gray went into didn't look to be following city law to a T. "This is a warning," Gray told one clerk. "Next time, ?it's a $2,000 fine."
If Gray felt a little weird about playing the role of a tough-talking law-and-order mayor in the same week that details emerged of a vast, illegal shadow campaign that helped him get elected in 2010, he sure didn't show it.
At one liquor store Gray huffed at the owners even though they weren't selling anything illegal: "We'll be back to make sure you're not selling rolling papers."
When LL asked Gray if he thought his recent troubles limited his effectiveness on jaunts like the one today (which his spokesman says was planned several weeks ago), Gray looked at LL like the mayor was Bryce Harper and LL was asking about his favorite Canadian beer.
"Not based on what I've seen," Gray said, with a finger pointed in the air.
Gray was warmly received by most non-store owners and clerks. Several people asked him for a job, and one woman urged him to stay strong in the face of the federal probe. "Don't let them try to get you," the woman said, before adding that she needed a job. Another woman at a different convenience store, however, looked annoyed that Gray was delaying her purchases. "Can you ring me up?" she said. "I gotta go to work."
Besides the talkin' to, businesses owners were also given a letter signed by Gray and Ward 8 Councilmember Marion Barry, who has had his fair share of drug-use issues in his past and caused a flap several months ago by denigrating the type of stores Gray visited today as "dirty shops" owned by Asians.
"The negative impact on illegal drugs in our community is devastating," the letter said. "We respectfully request that all businesses in this community stop selling rolling paper, blunts, miniature plastic bags (not containing jewelry), miniature scales, and loose cigarettes."
It did not seem like many of the foreign-born clerks would be able to read the letters without some assistance, as they often appeared to have no idea what the mayor was saying. Majett said it's a common ploy for immigrant clerks to claim poor English skills whenever dealing with the DCRA. "We always get that," he said. And Gray said they were still getting the message. "They don't speak English well, but they understand this is an enforcement visit," he said.
At one of the last stores Gray visited, a clerk tried to leave the enclosed space behind the counter after Gray and his entourage burst in. A mayoral staffer stopped her, and she got the anti-drug paraphernalia lecture, too.

Valuing a marital business, most typically a closely held business with no third party ownership interests, is almost always a difficult affair.
There are several different methods of valuation used by forensic accountants and other business valuation professionals.
And they can produce wildly different results. And none may strike either spouse as particularly ?spot on?.
Because, when you get right down to it, any way you cut it, it is really hard to nail down the true value of a small closely held business.
When spouses are inclined to settle their case amicably, all too often disputes over valuations and even calculations are settled (or settlement is attempted) predicated on the ?let?s split the difference? school of hard knocks method of valuation / calculation.
And at the settlement table, that may close the deal.
But, what about those cases where valuation is litigated? Where the experts are brought in to provide professional business valuations.
While in theory the testimony of valuation experts should make it straightforward for a family court judge to identify and establish an accurate value for a business, in reality it may not be quite that straightforward at all.
In one relatively recent Florida case, a Florida family court judge appears also to have followed that well-worn path to business valuation of just ?splitting the difference?. In any event, the final judgment failed to explain how the divorce court judge came up with his valuation ? but the number was in fact extremely close to a split of the difference between the two spouses? proposed valuations.
On appeal, an intermediate level appellate court held that this approach was an erroneous abuse of the family court?s discretion.
Surprisingly, there is a line of cases that concludes that various family court judges had ?split the difference?, and they reverse the various divorce court judges? holdings because they are not supported by ?competent evidence?.
Now in some of those cases, it may ultimately turn out that the final judgments simply failed to reflect in sufficient detail sounder methodologies actually employed by those Florida divorce court judges in establishing their valuations.
In others, perhaps not so much ? until remand back to the family court trial ? unless the spouses opt to avoid another trial ? and decide themselves this time around to split the difference instead. Stranger things have happened.

A new report says U.S. retail sales of video-game hardware, software and accessories fell for a seventh consecutive month.
Sales declined 29 percent in June to $700 million.
Sales of console and portable software ? the video games themselves ? fell 29 percent from a year earlier to $329 million. Sales of hardware fell 45 percent to $201 million. That was offset partly by a 4 percent increase in sales of accessories, to $170 million.
Thursday's report by NPD Group tracks sales of new physical products ? about 50 percent to 60 percent of the total spending. Excluded are sales of used games and rentals as well as digital and social-network spending.
The top-selling game was "Lego Batman 2: DC Super Heroes," from Time Warner Inc.'s Warner Bros. Interactive.

A global survey comparing consumer attitudes to customer service across major economies has scored Australia particularly poorly ? but it?s not all bad news for business, with the survey also proof of the rewards that flow to companies going the extra step.
The 2012 Global Customer Service Barometer, prepared for American Express, found 40 per cent of Australians felt businesses did not normally meet their customer service expectations. Only France recorded a higher dissatisfaction rating of the 11 countries profiled.
Thirty-six per cent of Australians declared there was now less attention on service, with 13 per cent saying they didn?t believe companies even cared about their custom ? again, this was the second highest rating of dissatisfaction, behind France.
The results of this survey are not all doom and gloom for business though. For those businesses that do provide excellent service, the rewards are clear. Nearly three quarters of Australians confirmed they?ve spent more with a business because of their history of quality customer service, and 71 per cent would be willing to spend more on excellent service.
The premium for good customer service is tangible, as is the punishment for poor service. Sixty-four per cent of Australians would always tell someone else about a poor service experience, and 65 per cent have not made an intended purchase because of bad service.
?(Australians) are less likely to call it out in the moment but are more likely to walk out and tell friends about their terrible experience and with social media much more prevalent, we see a lot more things on Facebook and different sites,? said American Express Australia?s Lisa Vehrenkamp.
The survey shows how a customer service experience can totally define a customer?s perception of a business, and of businesses in general. Australians are prepared to pull the pin on a purchase if they don?t get the service they desire, but will reward those businesses with good service, even if they have to pay a little more ? the best evidence yet of the reward for investing in customer service.

The creator of Angry Birds is about ready to launch their next franchise this week - a physics puzzler called Amazing Alex. Rovio has been teasing this game for awhile, and though it's being painfully branded towards tweens, I have no doubt the gameplay will be polished.
The game already did well for itself independently as Casey's Contraptions by developer Mystery Coconut last year, but Rovio had since acquired the company and is now molding it in their image. In all likelihood, that means lots of spin-offs and up-selling as per Angry Birds' precedent, but the trailer video below promises that there will be many free updates. Rovio also hints that there will be a level creator with sharing options, which should be pretty fun.
The Incredible Machine was always a favorite of mine, so I'm definitely glad to see this kind of Rube Goldberg gaming coming back. Anyone else eager to give Amazing Alex a try?

WASHINGTON (AP) ? A Canadian amateur astronomer has named an asteroid he discovered after U.S. gay rights pioneer Frank Kameny, who died last year in Washington.
Kameny, who earned a doctorate in astronomy at Harvard University, was an astronomer with the U.S. Army Map Service in the 1950s but was fired from his job for being gay. He contested the firing all the way to the Supreme Court and later organized the first gay rights protests outside the White House, the Pentagon and in Philadelphia in the 1960s.
Kameny died last year at age 86.
When astronomer Gary Billings read Kameny's obituary, he consulted with others in the astronomy world. They decided to submit a citation to the Paris-based International Astronomical Union and the Minor Planet Center in Cambridge, Mass., seeking to designate Minor Planet 40463 as Frankkameny.
It's located in the asteroid belt, orbiting between Mars and Jupiter. The Kameny asteroid is visible through a telescope and was first discovered in 1999 using long-exposure photography.
"Frank would show up as a little dot that moves between two points," Richard "Doc" Kinne, an astronomical technologist at the American Association of Variable Star Observers in Cambridge, Mass., said in an interview. He helped write the citation that would lead to the naming.
While comets are often named for their discoverers, those who discover asteroids have 10 years to suggest a name once the discovery is verified. The submission is subject to review by a 15-member international panel, said astronomy historian David DeVorkin at the National Air and Space Museum. Astronomers often use the names as an acknowledgement of someone's contributions to science or culture.
A published citation officially naming the asteroid on July 3 notes Kameny's history as a gay rights pioneer.
"Frank E. Kameny (1925-2011) trained as a variable star astronomer in the 1950s, but joined the Civil Rights struggle. His contributions included removing homosexuality from being termed a mental disorder in 1973 and shepherding passage of the District of Columbia marriage equality law in 2009," the citation reads in the Minor Planet Circular.
Kinne said he and Billings wanted to honor Kameny for his legacy, even though he was pushed out of the astronomy field.
After Billings read Kameny's obituary, he wrote to Kinne.
"Hey, I have a few asteroids I discovered that I haven't named yet," he said. "What do you say we name one after Frank?"
"I was utterly floored," Kinne said. "To me, this is a big deal."
Billings told Kinne he was moved by hearing the story of how he had met Kameny about three years ago in Washington and many passers-by stopped to thank him for his advocacy.
"I concluded he was a man I would have admired," Billings wrote to Kinne. "Add that to the fact that I have many friends and acquaintances who are members of the LGBT community, and I felt it was something I wanted to do to honour Dr. Kameny ? and my friends!"
Before Kameny died, Kinne and others had been working to present him with a certificate of recognition from the American Astronomical Society and perhaps create and fund an award in his honor. Kameny also received an official apology from President Barack Obama's administration for his firing years ago.
"He was an astronomer," Kinne said. "The culture of the time took that away from him, and now he's getting it back. He would have liked that."
Kinne and Billings submitted the citation for the asteroid late last year. By July, they hadn't heard whether it was approved and feared it had been rejected. On July 6, though, they got word that Kameny is an asteroid.
